Stellenbosch expels male student over alleged on-campus rape

Stellenbosch University’s Central Disciplinary Committee (CDC) found a male student accused of raping a fellow student guilty of sexual misconduct and expelled him on 4 August.

The alleged rape was reported to the South African Police Service (SAPS) on Wednesday, 18 May. As previously reported, SAPS spokesperson Captain FC van Wyk told The South African a 19-year-old woman was raped at approximately 22:30 on 17 May at a residence in Victoria Street, Stellenbosch.

The victim also reported the matter to the university’s Equality Unit, which referred it to Student Discipline for investigation and kicked off the process that eventually led to the alleged perpetrator’s expulsion on Thursday.

The CDC found the male student guilty of “instances of sexual misconduct” in the Majuba Residence on 17 May.

The sanctions imposed on him are:

1) The male student is expelled from Stellenbosch University.2) The sanction must be published in the student community in a suitable manner that does not reveal the identity of the parties and any witnesses.  The expelled student has five working days to appeal the CDC finding and sanction, in terms of the university’s disciplinary code.

Stellenbosch University’s Media Manager, Martin Viljoen, said the student’s criminal case is still before the court,  in a statement on Friday, 5 August.

“The University maintains a strict zero-tolerance approach to gender-based violence,” said Professor Deresh Ramjugernath, the Deputy Vice-Chancellor of Teaching and Learning.

“As Management, we reiterate our deep distress regarding incidents of sexual misconduct. The University condemns all forms of crime and any infringement on human rights including gender-based violence in the strongest possible terms. In line with our Unfair Discrimination and Harassment policy we will continue to combat gender-based violence on our campuses.”
