Rape Latest: Man jailed for 14 years for raping sleeping woman

A man who raped his friend while she was sleeping has been sentenced to 14 years in jail in the Greytown Regional Court.

SAPS regional spokesperson Captain Nqobile Gwala said that the man, Zama Lethuxolo Ngubane, 31, had raped his 24-year-old friend after going out partying with her during the day.

Victim was asleep when suspect sexually assaulted her

Gwala said police had arrested the man on the morning of 14 September 2019 following the reported rape. The victim was asleep when the suspect sexually assaulted her in her own home.

“On 13 September 2019, the victim was sleeping at her residence after parting. The accused realised that she was sleeping and he raped her. She woke up and realised she had been raped and questioned the accused, who denied harming her,” Gwala said.

“The victim was shocked and called her friend who took her to the police station where a rape case was opened.”

Gwala said that the rape docket that had been opened at the local police station was then transferred to the Greytown Family Violence, Child Protection and Sexual Offences Unit for further investigation.  The arrest of the suspect followed swiftly.

“He was arrested and appeared in the Greytown Magistrate’s Court before he was granted bail,” Gwala said. 

Suspect found to be a poor witness in court

“The matter was transferred to the Regional Court in Greytown and throughout the whole trial the accused denied the rape allegations which proved him to be a poor witness at court,” Gwala added.

“After the statement given by the victim and the evidence presented in court the state proved beyond a reasonable doubt that the accused was guilty.”

Gwala said the Greytown Regional Court sentenced Ngubane to 14 years direct imprisonment. “He was also declared unfit to possess a firearm,” she said.
