Rape LATEST: 81-year old man in court for sexually assaulting girl, 6

An eighty-one year old man has been sentenced to 15 years in prison for rape and the indecent assault of a six-year old child who had attended his nursery school in Balfour.

National Prosecuting Authority regional spokesperson, Monica Nyuswa, said that the man was sentenced in the Secunda Regional Court last week after earlier being found guilty of the rape and assault of the girl in 2004.

“This was after the court convicted the accused of indecent assault and rape of a minor girl last month, the accused was sentenced to four years imprisonment for indecent assault and fifteen years for rape. The court ordered the sentences in counts 1 and 2 to run concurrently,” Nyuswa said.

The girl had attended a nursery school that was owned by the man and his wife in Balfour in 2004.

“On the day of the incident, the accused coerced the minor girl to accompany him into a bedroom and promised to give her a packet of peanuts. When she entered the room, he locked the victim inside, tied her up, undressed her clothes and raped her,” she said.

“Though the matter was reported nine years later, the state led evidence of the victim who testified that the accused threatened to rape her again should she report the rape ordeal to anyone,” Nyuswa said.

 The victim’s mother testified during the rape trial.

A forensic assessment report was also presented including a J88 report which proved that the victim had been sexually assaulted.

Life sentence for rape not handed down

“During sentencing,  the court found that there were compelling circumstances to deviate from the sentence of life, as it took into consideration the accused’s age and sentenced him accordingly,” she said.

Acting Director of Public Prosecutions in Mpumalanga Advocate Sonja Ntuli applauded the collaborative efforts of the state prosecutor, Tracy Keen Horack and the police to achieve the successful prosecution.
