Man in UK accuses aunt of schemes to fraudulently acquire his land in Nairobi

A man residing in the United Kingdom and his aunt are in court over ownership of land situated in Uthiru, Nairobi.

Raoul Emanuel Muchene says that his aunt Racheal Nduta Mwaura is out to fraudulently acquire his father’s land.

Raoul wants Nduta evicted from the said property insisting she has no proprietary right over the said land and should surrender the land.

He says that his grandfather Caxton Mukiri Muchene was survived by five children including his dad and that, in the disputed land, the family homestead was built and was given to his late father in accordance with the customary law which allegedly required that the 1st son inherits the family homestead.

He further claimed that when the aunt returned home with her children after she separated from her husband, since she had no accommodation for herself and her two children.

The late Grandfather in agreement with the family allowed her back into the property to temporarily stay there as she prepared to develop her share from the family property,” Raoul says

He claims that they easily allowed her back into the suit since they lived and worked in the UK and had no immediate plans to develop the said property.

He told the court that when his father retired from the UK and came back to the country to develop a home for his family on the property, he was surprised when Nduta declined to surrender the property.

The plaintiff’s effort to recover their property and develop the same have hit a snag with the defendants refusal to vacate the same, even though the defendants continued to reap the benefits of her own property which she developed while sitting on it,” reads court papers

But while testifying before the court, the aunt insisted that she returned home as a daughter and has right to own the said suit as a Daughter.

She told the court that she is staying in that home because her late father told her to do so soon after she separated with her husband in 1980. She says that she is keeping the land as a customary trust.
