Drama in Court as Shumuk’s Lawyers Move to Stay Proceedings

Buganda Road Magistrates court has entered a second hearing of the case in which the family of the Late Bonny Katatumba accuses businessman Shukla Mukesh (Shumuk) of uttering false documents with an intention of grabbing Hotel Diplomate in Muyenga.

The case came up for further hearing with a continuation of Mukesh’s defence, however, his lawyer notified the trial Magistrate Marion Mangeni that they had filed an application before High court seeking to stay the proceedings before the lower court.

Asked whether he had served court with the application staying the hearing of the matter, the lawyer said he was in the process to.

The magistrate asked Mukesh’s lawyer to effect service so that it can have a legal back up to base upon and come up with a clear position.

“I can’t comment on the said application which has not been served to this court, once I receive it,  I will act accordingly but for now let us resume with further hearing of the case,” she said.

The defense counsel insisted that he wasn’t prepared, however, the Magistrate called on the accused, Mukesh, to proceed with his defence.

Mukesh presented to court documents which included copies of sale agreements for plot 970, 971 located in Kidugu, two statutory declarations, and Police Report indicating that there was tress pass on his land by the Katatumba family.

Meanwhile, when Mukesh was shown the affidavit attached to the application he filed at Makindye Magistrates court, he told court that he wasn’t sure whether the signature or it belonged to him or somebody.

He requested for more time to verify it.

However, prosecution objected to the said documents on grounds that he is not the author of the same and therefore he cannot use them in his defence as he is not the original author.

The matter has been adjourned to next month for further hearing.

Prosecution contends that Mukesh Babubhai Shukla and others still large, on or around 17th April 2017, in Kampala city business center, with intent to defraud or deceive, forged a letter for official hand over of Hotel Diplomate Muyenga, purported to have been signed by Bonny Mwebesa Katatumba,  the former consulate for Pakistan, and other family members, where as not.
