DJ Shan Threatens to Sue MAMAs Organizers over Copyright Infringement

Renowned DJ real name Nalugoda Shaban alias DJ Shan has, through his lawyers Nalukoola, Kakeeto advocates and solicitors, threatened to drag the organizers of the MTV Africa Music Awards to court over copyright infringement.

DJ Shan accuses the organizers for using his content and image in the MAMAs advert without his consent.

According to the letter with ‘intention to sue’ seen by ChimpReports, Shan reveals that his fans have been congratulating him upon his contribution to the upcoming awards ceremony as per the advert content yet he is not either a nominee or performer at the event and was not consulted before his content was used in the advert.

“Our Client who is not among nominees, performers or organizers, his consent was never sought before adopting his content and image in the said advert which amounts to infringement of copyright,” reads part of the letter.

“Ever since the inauguration of the advert for the said MAMAs 2021,you have with impunity used our client’s artisan work without his clearance for its digital use or even providing attribution to him as the creator of the content and or having a right over his creative work,” the letter further reads.

The letter dated 22nd December 2020, addressed to Viacom international media networks Africa Pty Ltd, CEO MTV Networks Africa but(Pty)Ltd and CEO Uganda Tourism Board (UTB), the BBS TV DJ, according to Nalukoola, Kakeeto advocates and solicitors, informs the organizers of the awards to desist from using his content among other demands.

“Take note that we are under instructions to demand as we hereby do that you; henceforth cease and desist from using our client’s creative work without his permission/consent, furnish in our chambers a sum of USD 1,000,000 as reparation for the damages and suffering you so far caused to our client and furnish in our chambers a sum of USD 100,000 which our client has so far incurred whilst instructing us.”

The letter further states that if the above said demands are not met within 4 days from the time of its issuing, they will proceed to institute a legal proceeding against the named companies and organizations.
