The High Count has restrained the Inspector General of police and the director of public prosecutions from arresting and prosecuting 2 accused persons in a case against business man Jimi wanjigi.
High Court Judge Antony Mrima said the two, Kaneez Noorani and Mohamed Hussan Ali shall not be arrested nor prosecuted pending the hearing and determination of an application they have lodged.
Their lawyer John swaka said the 2 accused persons cannot attend the court as summoned since the High Court has stopped their prosecution.
The Court However extended summons against the first accused Himanshu Velji and 5th accused Augustine Thuo and 6th accused John Njenga to appear in court on March 18th.
The Prosecution informed the court that Mohammed Hussein Ali is deceased with the court directing for verification of the same to ascertain if indeed the accused had passed on.
The two are accused of conspiracy to commit a felony together with others by forging a title deed for some land in Westlands under the Horizon Hills Limited.
They are charged alongside Jimi Wanjigi, his wife Irene Nzisa among others. The matter will come up for directions on 9th February 2022.
