Court of Appeal judges have unanimously agreed to dismiss an application filed by Mujungu Jennifer, a former contestant for Ntoroko Woman Member of Parliament in the 2021 General elections
The Applicant lost the election to Hon Tumwine Anne Mary and decided to challenge the results in court, which she lost at High Court, forcing her to appeal before the Court of Appeal.
In the appeal, Mujungu had asked the appellate court to entertain more evidence, but in their ruling, the judges Geoffrey Kiryabwire, Stephen Musota and Christopher Gashribake unanimously dismissed it with costs.
The Judges noted that for an order for admission of additional evidence is granted where sufficient cause has been shown and also in exceptional circumstances which was not the matter in this case.
“Has the test of sufficient cause and exceptional circumstances been discharged in this matter? We find not?”
