Unlawful discrimination occurs when a group of people, people are treated less favorably than any other person or group of persons because of their ethnicity, race, color, sex, marital status, age or disability, religion and sexual reference, if the member of a union, and any other features specified in discrimination or human rights law.

Discrimination and harassment can occur in:
· Employment and selection.
· Training and the type of training offered.
· To be considered for a transfer, promotion or dismissal.
· Work with site conditions.

What is defined as harassment?
Under the state of Australia and federal legislation unlawful harassment can occur when a person because of race humiliated or intimidated and insulted by no color, ethnicity, or any other characteristic specified in discrimination or human rights law.

Bullying may include behaviors such as:
· Mail or send sexually explicit or suggestive letters, notes or emails.
· The performance of derogatory jokes or comments about the people of one religion or race. telling insulting jokes about a particular racial group.
· Posters Nude or pornographic shows.
· Formulation of questions about sexual life of persons or personal life.

The nature of harassment and discrimination o.
No matter the severity of an incident, whether a call at one time or long-term and long term, will be judged as harassment or discrimination. If left unchecked the continued harassment of unity and erode the ability of the person or group to carry out, finally, the overall performance of your job performance.

However, the absence of formal or verbal complaints is not necessarily an indication that the harassment or discrimination is not occurring. In many cases the person or group harassed or discriminated against does not complain or report the incident in the belief they will be considered extreme or the incident is too trivial. In most cases the victim of harassment or discrimination is a lack of confidence in their ability and is afraid of retaliation or, worse, being dismissed.

Hostile Work Environment
As an employer you will also need to be aware of their responsibilities in making the work environment a safe place, a culture of sexual or racial harassment. Both are considered as hostile. An example of a potential hostile work environment include the display of material talks, swearing and crude naked or pornographic, racial or sexual jokes specific.

What can not be classified as harassment or discrimination.
However, it must be remembered that the observations and recommendations given by supervisors, co-workers and managers on the performance of work or work related to the behavior of an individual or group should not be confused with bullying or discrimination.
Information during normal performance evaluations and performance meetings will always be regarded as stressful and in some cases the effect of the welfare of the person or group being evaluated. However, managers and supervisors should always keep in mind these concerns and make any necessary appraisal with sensitivity without avoiding the need to provide full and frank information from its staff.

What is bullying?
The origin of ACTUQ Department Government / QCCI / Queensland, Safety and Occupational Health, say that bullying is "the repeated less favorable treatment to one person by another or others in the workplace, which can be considered a practice reasonable and appropriate work. That includes behavior that intimidates, offends, degrades or humiliates a worker ".

Bullies use their power status or position in a company or business to target both men and women with their practices of intimidation. Bullying behavior can vary from obvious verbal or physical assault to very subtle psychological abuse.

This behavior include:
· The psychological harassment. (Mind Games)
· Excluding or isolating employees of destination.
· Assigning impossible tasks or jobs for employees.
· Physics or verbal abuse.
· Discomfort selected employees by deliberately changed job listings and changes.
· Yelling and shouting offensive language.
· Intimidation
· Undermining work performance by deliberately withholding information vital work.
